This Terms of Service and Privacy Policy (the "Agreement") governs your use of the parking registration platform operated by Regium Management Corp ("REGIUM", "we", "us", or "our"), accessible at https://park.iyap.ca (the "Site").

By accessing, browsing, registering, or otherwise using the Site, you acknowledge that you have read, understood, and agree to be legally bound by this Agreement. Your use of the Site constitutes full acceptance of these terms without the need for a separate signature or written consent.

1. Purpose Of The Platform

The Site is a parking management system that allows users to register vehicles for temporary or authorized parking, avoid towing by maintaining valid registration, make payments for parking or extensions, and receive notifications related to parking status. The Site functions as a facilitation tool only and does not guarantee parking rights or immunity from enforcement.

2. User Responsibilities (Strict Liability On User)

You agree that all information you provide is accurate, complete, and current. You are solely responsible for entering the correct license plate, selecting the correct parking space, and ensuring your registration is active and valid. Any errors, omissions, typos, or incorrect entries are entirely your responsibility. Failure to properly register your vehicle may result in ticketing or towing, and you accept full responsibility for any resulting consequences.

3. No Liability

To the fullest extent permitted by law, REGIUM, the property owner, property manager, and any affiliated parties are not liable for towing of your vehicle, tickets or fines, incorrect registrations, system errors, outages, or delays, or missed reminders or notifications. The system is provided "as-is" and "as-available" with no guarantees.

4. Parking Enforcement & Towing

You acknowledge and agree that parking rules are enforced by the property owner and or authorized towing providers. If your vehicle is not registered, incorrectly registered, or expired, it may be ticketed or towed without notice. We reserve the right but not the obligation to attempt to contact you before enforcement.

5. Use Of Historical Data For Contact

You explicitly agree that if your vehicle is found parked without valid registration, we may search prior records linked to your license plate and use previously provided contact information to call you, send SMS messages, or attempt to resolve the issue before towing. This applies even if you did not register for the current parking session.

6. SMS Communications (Twilio)

By using the Site, you consent to receive SMS reminders, parking alerts, enforcement warnings, and registration confirmations. Messages are delivered via Twilio. Message frequency may vary. You are responsible for any carrier charges, including SMS or data fees. REGIUM is not responsible for messaging costs or delivery failures. Opting out may limit functionality.

7. Payments (Stripe)

All payments are processed through Stripe. We do not store full payment card details. You agree that payments are final unless otherwise stated and that any payment errors due to incorrect input are your responsibility. We may receive limited transaction details for record keeping, fraud prevention, and compliance.

8. Sharing And Service Providers

We share information with companies that help us operate the Site, including hosting, analytics, security, payments, messaging, and enforcement services. These may include Stripe, Twilio, property management companies, property owners, and towing and enforcement companies. These providers act on our instructions and are bound by appropriate safeguards. We do not sell personal information or share it for cross context behavioral advertising.

9. Information We Collect

We collect information you submit such as name, phone number, email, and vehicle details, account details such as username and login information, transaction related information processed by payment providers, and technical data such as IP address, browser type, pages viewed, and approximate location.

10. How We Use Information

We use your information to operate, maintain, and secure the Site, manage parking registrations, process payments and prevent fraud, contact you regarding your vehicle, enforce parking rules, and meet legal, tax, and accounting obligations.

11. Cookies And Similar Technologies

We use cookies and similar technologies to run the Site, remember user preferences, and understand how visitors use the Site. You can manage cookies through your browser settings.

12. Data Retention

We keep personal information only as long as necessary for the purposes described above, generally about 12 months, unless required longer for legal, tax, or security reasons.

13. Your Privacy Rights (Canada PIPEDA And Law 25)

Depending on your location, you may have rights to access your information, correct your information, request deletion, withdraw consent, and restrict certain processing. 14. Security

We take reasonable measures to protect your data. However, no system is completely secure and we cannot guarantee absolute security.

15. Children

This Site is not intended for children.

16. Changes

We may update this Agreement from time to time. We will revise the Effective Date and post the updated version on the Site. Continued use means acceptance of the updated terms.
